Terms of Use

In short: ChartTheWind reports are estimates, not measurements taken at your property. They are advisory only, provided as is, not certified weather data, and not professional advice. Please read the limitations below before relying on one.

1. About these terms

ChartTheWind (the “Service”) produces estimated wind reports for a United States address and date range. By viewing the site, running a free preview, or paying for and running a report, you agree to these terms. If you do not agree, do not use the Service.

2. What a report is

A report is an estimate. It is derived from public weather-station observations and, where observations are missing, model data, adjusted using published methods for the terrain and land cover around the address.

Values shown for the property, including local and roof-level wind, are estimates of conditions that were likely experienced. They are not measurements taken at the property and may be higher or lower than the winds that actually occurred.

3. Advisory only; no warranty

Reports and all other content on this site are wholly advisory in nature and are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement, and any warranty as to the completeness, accuracy, currency, timeliness or predictive value of any report or data. We do not warrant that the Service will be uninterrupted or error-free.

4. Not certified data or professional advice

Reports are not certified weather data, are not a National Weather Service or NOAA product, and are not endorsed by NOAA or any government agency. Certified copies of NOAA climatological records for use as evidence are available only from NOAA’s National Centers for Environmental Information (NCEI).

Reports are not engineering, meteorological, legal, insurance, public-adjusting or other professional advice, and ChartTheWind is not an engineering or meteorological firm. Do not use a report as the basis for structural design, building-code compliance, life-safety decisions, or any representation that a particular wind speed occurred at a particular property.

You decide whether and how to use a report. Verify anything important independently before relying on it. You are responsible for the accuracy of the address and dates you enter.

If you share or submit a report to anyone (for example an insurer, contractor, adjuster or court), you must share it unaltered and with all notices and disclaimers intact, and you must not describe it as measured, certified, official, or as the opinion of ChartTheWind.

A report may be used only for the address it was run for and is for your own use or for the person or entity on whose behalf you ordered it. You must not resell, license or redistribute the Service or its output as a product of your own, and you must not modify, forge, alter, reorder, obscure, manipulate, misrepresent or augment a report or any notice, disclaimer or qualification in it, or use a report in connection with any misrepresentation or fraud. We may refuse or end service to anyone we reasonably suspect of doing so.

7. Third-party data and services

The Service relies on public weather-station data, model data, geospatial and elevation data, address-lookup services, satellite imagery and payment processing supplied by third parties under their own terms. We do not control them and are not responsible for their availability or accuracy. Satellite imagery on the home page is loaded directly from Esri’s servers; payments are processed by PayPal under PayPal’s terms and privacy policy.

8. Payment and refunds

Each report costs the price shown at checkout, paid once per report through PayPal. One payment runs one report. If a run fails before results are delivered to you, the payment is not used up and you may try again without paying again.

Because results are delivered immediately and are not stored, payments are otherwise non-refundable except where required by law. Save your PDF when the report finishes: we cannot recover a report after you close the page.

9. Privacy

There are no accounts, and this site sets no cookies of its own. We use the address and dates you enter only to run your report. We do not store your reports.

We keep a record of each payment (PayPal order ID, amount, time and the payer email PayPal provides) so a paid report cannot be reused. Our servers keep standard operating logs (IP address, time, requested URL, and approximate location of the address) for security and troubleshooting; these do not contain the address you entered or the report. Third parties such as PayPal and Esri receive information directly from your browser under their own policies.

10. Acceptable use

Do not scrape or bulk-query the Service, attempt to bypass payment or usage limits, interfere with its operation, resell reports as your own service, or misrepresent a report. We may block access that we believe is abusive.

11. Limitation of liability

To the fullest extent permitted by law, ChartTheWind and its owners, operators and contributors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, denied or reduced insurance claims, repair or replacement costs, or loss of data, arising out of or related to the Service or any report, even if advised of the possibility of such damages.

Our total liability for any claim relating to a report is limited to the amount you paid for that report. Some jurisdictions do not allow certain limits; where that applies, our liability is limited to the fullest extent permitted.

12. Indemnity

You agree to indemnify and hold harmless ChartTheWind and its owners and operators from claims, losses and expenses arising from your use of a report, your breach of these terms, or your representing a report to anyone as measured, certified or official.

13. Changes

We may change or discontinue the Service, its price, or these terms at any time. Changes apply to use after they are posted, and the date above shows the latest update.

14. General

These terms are the entire agreement between you and us about the Service. If a provision is found unenforceable, the rest remains in effect. You may not assign these terms; we may.
